Refund and Cancellation Policy

If, for any reason, You are not completely satisfied with a purchase We invite You to review our policy on refunds and cancellations.

The Refund and Cancellation Policy is incorporated by reference to, and forms part of our Terms of Service, use of our learning management system (LMS) and Privacy Policy and is subject to any additional conditions that may apply to single and multiple courses, course material or Study programs as per the specification on the relevant product.

The following terms are applicable for any products that You purchased with Us.


Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of this Refund and Cancellation Policy:

Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to Binah Bible College NPC, 736 Belmont Street, Suiderberg, Pretoria.

Product or Products means any course, study program, service, book, software, CD, DVD, media carrier, audio, video or any other downloaded data or multi-media file or other items offered for sale on the Service.

Order mean a request by You to purchase products from Us.

Service refers to the Website and Learning Management System.

Website refers to Binah Bible College or Learning Management System (, accessible from https://binahbiblecollege.co.za)

You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

ECT Act means the Electronic Communications and Transactions Act (https://www.gov.za/sites/default/files/gcis_document/201409/a25-02.pdf )

Your Order Cancellation Rights

In order to exercise Your right of cancellation, You must inform Us of your decision by means of a clear statement. You can inform us of your decision by email: support@binahbiblecollege.co.za

Statutory Returns

Section 44 of the ECT Act may apply to your order. Section 44 is only applicable if you are a natural person – in other words, a human being. You must also be the end user of the training or service. If you qualify as a consumer under the ECT Act, you may be entitled to cancel some electronic transactions within seven days, without reason or penalty, but once you have opened or downloaded the material, no refunds will be granted.

Exclusions

The following products CANNOT be cancelled or returned in terms of the ECT Act:

Unsealed, downloaded or opened software or other audio or video recordings or electronic files, whether downloaded or acquired other wise,

books, tools, magazines or other periodicals, and

specially sourced or customized items on your request including training courses, modules or programs sourced, adapted or customized specifically to you or your organization’s needs,

Courses, study programs, training purchased on our online platform.

Returning Goods

For physical products that do not fall under the Statury Right category, You are responsible for the cost and risk of returning such products at your own expense to Us. You should send the Products to the following address:

We cannot be held responsible for Products damaged or lost in return shipment. Therefore, We recommend an insured and trackable mail service. We are unable to issue a refund without actual receipt of the Goods or proof of received return delivery.
